Terms of Service for talkspark

1. Scope and Acceptance

These Terms of Service govern your use of the talkspark mobile application and the talkspark website.

By accessing or using talkspark, you agree to these Terms. If you do not agree, do not use the app or website.

2. Eligibility

talkspark is not intended for children. You must meet the minimum age required in your country or region and any age rating shown for the app in the App Store.

3. Description of the Service

talkspark is a conversation starter app that provides curated question decks for personal and social use.

Some app features may store data locally on your device. Answer Together is an optional feature that allows two users to create accounts, pair with each other, answer shared questions, view shared round activity, react to answers, and exchange messages within eligible shared question rounds.

4. Answer Together Accounts

To use Answer Together, you must create or sign in to an Answer Together account. You are responsible for keeping your account access secure and for using an email address that you control.

You may update your display name or nickname in the app. Your display name may be shown to your active pair.

You may request deletion of your Answer Together account from inside the app. Account deletion is handled as described in our Privacy Policy. Deleting an Answer Together account does not cancel Premium. Premium subscriptions are managed through your Apple ID subscriptions.

5. Pairing, Shared Answers, and Chat

Answer Together is designed for use with one active pair at a time. You may send or accept an invite code to pair with another user. Either paired user may unpair.

When you use Answer Together, you are responsible for the answers, messages, and other content you submit. Do not submit content that is unlawful, abusive, harassing, threatening, invasive of another person's privacy, or otherwise harmful.

Answer Together includes private answer and reveal behavior. For example, your answer may stay hidden from your pair until both users have answered, and then your answer may be shown to your active pair according to the app's design.

Answer Together Chat allows paired users to exchange messages within eligible shared question rounds.

Users may report eligible Chat messages. talkspark may review reports and take action where appropriate to enforce these Terms, protect users, or protect the service. Submitting a report does not guarantee that particular content will be removed or that a specific action will be taken.

Emoji reactions and shared round activity may also be shown to your active pair.

6. License to Use

talkspark grants you a limited, non-exclusive, non-transferable, revocable license to use the app for personal, non-commercial purposes, subject to these Terms.

You may not:

• copy, modify, or distribute the app or its content except as expressly permitted
• sell, sublicense, or commercially exploit the app or its content
• reverse engineer or attempt to extract source code
• use the app in any unlawful, abusive, or harmful manner
• misuse Answer Together invites, pairing, answers, reactions, Chat, reports, notifications, or account features
• attempt to bypass subscription access controls, account controls, pairing controls, or security features

7. Premium Subscriptions and Payments

Premium subscriptions are processed through Apple's App Store using Apple's in-app purchase system.

Subscription terms include:

• subscriptions automatically renew unless cancelled at least 24 hours before the end of the current period
• payment will be charged through your Apple account according to the purchase terms shown by Apple
• renewal charges occur within 24 hours before the end of the current period
• pricing and subscription options are displayed in the app at the time of purchase

You can manage or cancel Premium through your Apple ID subscription settings. talkspark cannot cancel Apple ID subscriptions on your behalf.

If a free trial is offered, you will not be charged until the trial period ends. To avoid being charged, cancel at least 24 hours before the free trial ends, subject to Apple's terms.

8. Premium Ownership and Paired Access

Direct Premium means the purchaser has Premium through the Apple ID used for the purchase.

Premium ownership remains with the purchaser's Apple ID. Premium is not transferred to another user by pairing.

Paired access means a free user may receive temporary access to certain Premium features while actively paired with a direct Premium user. Paired access is a feature access benefit only. It is not transferable Premium ownership, not a separate subscription, and not a right to keep Premium access after the active pair ends or the direct Premium user's access changes.

9. Restore Purchases

If you previously purchased Premium, you may restore access using the "Restore Purchases" feature in the app, subject to Apple's systems and these Terms.

10. Acceptable Use

You agree not to:

• use talkspark in a way that violates applicable laws or regulations
• interfere with operation of the app, security, or account controls
• attempt to bypass Premium, paired access, free round, or deck access rules
• abuse invite codes, pairing, notifications, reactions, Chat, reporting, or account deletion requests
• harass, threaten, impersonate, or harm another user
• submit content that you do not have the right to submit

talkspark may limit, suspend, or terminate access if these Terms are violated, if misuse is detected, or if needed to protect the app, users, or service providers.

11. Intellectual Property

All content in the app, including text, question decks, design elements, logos, and trademarks, is owned by talkspark or its licensors and is protected by intellectual property laws.

Sharing individual question cards using the app's built-in sharing features is permitted for personal, non-commercial use.

You may not use talkspark's name, logo, or branding without prior written permission.

12. Availability and Service Changes

talkspark is provided on an "as available" basis. Features may change, be unavailable, or be discontinued from time to time.

Answer Together, paired access, notifications, subscription verification, and online services depend on network availability and third-party systems. talkspark does not guarantee uninterrupted access or any specific outcome from using the app.

13. Disclaimers

The app is intended for general personal, social, and entertainment purposes. talkspark does not provide professional, medical, legal, relationship, or mental health advice.

To the maximum extent permitted by law, talkspark disclaims all warranties, express or implied, including fitness for a particular purpose and non-infringement.

14. Limitation of Liability

To the maximum extent permitted by applicable law, talkspark shall not be liable for indirect, incidental, special, consequential, or punitive damages arising out of or related to your use of the app or website.

Nothing in these Terms limits liability where such limitation is prohibited by law.

15. Termination

talkspark may suspend or terminate access to the app or specific features if these Terms are violated, if the service is discontinued, or if needed to protect the app, users, or service providers.

Termination or deletion of an Answer Together account does not cancel Premium. Premium cancellation must be handled through your Apple ID subscriptions.

16. Changes to These Terms

talkspark may update these Terms from time to time. Changes take effect when posted. Continued use of the app or website after changes indicates acceptance of the updated Terms.

17. Governing Law

These Terms are governed by and construed in accordance with the laws of Singapore, without regard to conflict of law principles.
